NOTICE OF TAX FORECLOSURE SALE STATE OF NORTH CAROLINA COUNTY OF ONSLOW IN THE GENERAL COURT OF JUSTICE DISTRICT COURT DIVISION 16 CVD 4372 ONSLOW COUNTY Plaintiff, vs Any HEIRS, ASSIGNS, or DEVISEES of ASILEE J. SMITH, and SPOUSE, if any, or any OTHER PERSON or ENTITY CLAIMING THEREUNDER, and Any HEIRS, ASSIGNS, or DEVISEES of ASILEE S. GRAHAM, and SPOUSE, if any, or any OTHER PERSON or ENTITY CLAIMING THEREUNDER, and ERASTUS SMITH, JR. and any HEIRS, ASSIGNS, or DEVISEES of ERASTUS SMITH, JR., and SPOUSE, if any, or any OTHER PERSON or ENTITY CLAIMING THEREUNDER Defendant(s). and UNITED STATES OF AMERICA, Lienholder(s). Under and by virtue of an order of the District Court of Onslow County, North Carolina, made and entered in the action entitled "COUNTY OF ONSLOW vs. Heirs of Asilee Smith, et.al., FILE NO: 16CVD4372 the undersigned Commissioner will, on the 23rd day of March 2018 offer for sale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in Onslow County, North Carolina in Jacksonville, North Carolina at 9:00 o'clock, A.M., the following described real property, lying and being in Stump Sound Township, State and County aforesaid, and more particularly described as follows: Parcel I.D. Number 024813: Lots # 86 and 87 as shown on map of T.B. Henderson property which map is recorded in Map Book 1 at page 33, Onslow County Registry, and to which map reference is hereby made for a more accurate description. Parcel I.D. Number 024814: Lots # 84 and 85 as shown on map of T.B. Henderson property which map is recorded in Map Book 1 at page 33, Onslow County Registry, and to which map reference is hereby made for a more accurate description. The undersigned Commissioner makes no warranties in connection with this property and specifically disclaims any warranties as to title and habitability. This property is being sold as is, without opinion as to title or any other matter. An Order for Possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement upon 10 day's written notice to the landlord. The notice shall also state that upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination. This sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause. A cash deposit of 20 percent of the successful bid will be required. In addition, the successful bidder will be required, at the time the Deed is recorded, to pay for recording fees and revenue stamps assessed by the Onslow County Register of Deeds.
