RESOLUTION OF INTENT TO PERMANENTLY CLOSE A PORTION OF BRIDGE STREET WHEREAS, N.C. Gen. Stat. Section 160A-299 prescribes the procedure to be followed by a town in order to permanently close a street or alley; and WHEREAS, the Board of Commissioners for the Town of Bridgeton has determined that it is advisable to consider permanently closing the portion of Bridge Street located between E Street and Highway 17; and WHEREAS, in order for a municipality to property and lawfully permanently close a street, N.C. Gen. Stat. Section 160A-299 requires that a town first adopt a resolution declaring its intent to permanently close the street (or portion thereof) in question and then call a public hearing on the question. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Town of Bridgeton as follows: 1. It is the intent of the Town of Bridgeton to permanently close the portion of Bridge Street between E Street and Highway 17. Said portion of Bridge Street is located within the corporate limits of the Town of Bridgeton. 2. A public hearing on the matter of the above-described proposed permanent closure of the above referenced portion of Bridge Street is hereby called and is to be held at the regular meeting of the Board of Commissioners of the Town of Bridgeton on July 11 2014 at 7:00p.m. in the Bridgeton Town hall located at 202 B Street, Bridgeton, NC. At said public hearing, any person may be heard on the question of whether or not the intended closing of the specified portion of Bridge Street would be detrimental to the public interest or the property rights of any individual. 3. The Town Clerk is hereby directed to cause the publication of this Resolution once a week for four (4) successive weeks prior to the above referenced public hearing in the Sun Journal, a newspaper of general circulation in the Town of Bridgeton, Craven County. 4. The Town Clerk is further directed to transmit a copy of this Resolution by registered or certified mail to each owner of property adjoining Bridge Street. The identity of said property owners to be determined on the basis of the Craven County Tax Department's records. 5. The Town Clerk is further directed to cause the prominent posting of this Resolution in a minimum of two (2) locations along the portion of Bridge Street that is proposed for closure, as required by N.C. Gen. Stat. Section 160A-299. Upon Motion duly made by Commissioner Tyndall , and duly seconded by Commissioner Chittick, the above resolution was duly adopted by the Board of Commissioners for the Town of Bridgeton at the regular meeting held on June 11, 2019.
