MATTOCKS, and SPOUSE, if any, or any OTHER PERSON or ENTITY CLAIMING THEREUNDER Defendant(s), and RUBY JANE MATTOCKS, and any HEIRS, ASSIGNS, or DEVISEES of RUBY JANE MATTOCKS, and SPOUSE, if any, or any OTHER PERSON or ENTITY CLAIMING THEREUNDER Defendant(s), and SARAH MATTOCKS, and any HEIRS, ASSIGNS, or DEVISEES of SARAH MATTOCKS, and SPOUSE, if any, or any OTHER PERSON or ENTITY CLAIMING THEREUNDER Defendant(s), and CLEMATINE MATTOCKS, and any HEIRS, ASSIGNS, or DEVISEES of CLEMATINE MATTOCKS, and SPOUSE, if any, or any OTHER PERSON or ENTITY CLAIMING THEREUNDER Defendant(s), Under and by virtue of an order of the District Court of Onslow County, North Carolina, made and entered in the action entitled "COUNTY OF ONSLOW vs. Audrey Fay Mattocks Smith, et.al., FILE NO: 16CVD057 the undersigned Commissioner will, on the 25th of July 2017 offer for sale and sell for cash, to the last and highest bidder at public auction, at the courthouse door in Onslow County, North Carolina in Jacksonville, North Carolina at 9:00 o'clock, A.M., the following described real property, lying and being in White Oak Township, State and County aforesaid, and more particularly described as follows: From Jacksonville eleven miles on Highway No. 17 to a dirt road, No. 1439, through this road 1.2 miles and beginning at an iron stake, Mattocks corner 63 feet from center of said dirt road and also North 22 degrees West from light pole M4-13 and runs with the old line and a ditch South 6 degrees East 150 feet to a stake, thence South 371/2 degrees East 155 feet to a stake, thence North 6 degrees 150 feet to an iron pipe on a ditch and also on said road, thence with said ditch North 371/2 degrees West 155 feet to the beginning, containing acres, more or less. The undersigned Commissioner makes no warranties in connection with this property and specifically disclaims any warranties as to title and habitability. This property is being sold as is, without opinion as to title or any other matter. An Order for Possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement upon 10 day's written notice to the landlord. The notice shall also state that upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination. This sale will be made subject to all outstanding city and county taxes and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause. A cash deposit of 20 percent of the successful bid will be required. In addition, the successful bidder will be required, at the time the Deed is recorded, to pay for recording fees and revenue stamps assessed by the Onslow County Register of Deeds.
