NORTH CAROLINA LENOIR COUNTY NOTICE OF SALE IN THE GENERAL COURT OF JUSTICE SUPERIOR COURT DIVISION BEFORE THE CLERK File #19-SP-75 DOLORES POTTER and husband LEMUEL JERRY POTTER, Petitioners vs. DIANE LANE STALLARD and husband, DAVID STALLARD, JIMMIE THOMAS LANE, JR. and wife, DIANE HEATH LANE, FRANKIE LANE and wife, DONNA LANE, HEATHER LANE REESE, ALEXIS MCCENZIE LANE, and JAIDEN LANE, Respondents Under and by virtue of an Order of Sale of the Clerk of Superior Court of Lenoir County, North Carolina, entered on the 6th day of August, 2019, made in the above entitled action, on WEDNESDAY THE 25TH DAY OF SEPTEMBER, 2019, AT 10:00 A.M. AT THE LENOIR COUNTY COURTHOUSE DOOR IN THE CITY OF KINSTON, NORTH CAROLINA, the undersigned Commissioner will sell, at public auction, to the highest bidder for cash, that certain tract or parcel of land located in Lenoir County, North Carolina, and more particularly described as follows: BEING Lot #1 as shown upon map of the Plan of the Subdivision of the Millard Woodard land located in La Grange, Lenoir County, North Carolina, prepared by Alfred Chaney, R.S., February 23, 1956, said map being of record in Map Book 7, Lenoir County Registry, and said Lot #1 fronting 100 feet on the East side of Spring Hill Road. See deed recorded in Book 446, Page 319, Lenoir County Registry. Being the same property conveyed by deed recorded in Book 937, Page 219, Lenoir County Registry. The property to be sold is identified by the Lenoir County Tax Department as follows: LOCATION PARCEL# 405 S. Caswell St, La Grange, NC 356609067313 The property to be sold pursuant to this Notice of Sale is being offered for sale, transfer, and conveyance "AS IS, WHERE IS." Neither the Commissioner nor the officers, directors, attorneys, employees, agents or authorized representatives of the Commissioner or the owners of the property make any representation or warranty related to the title or any physical, environmental, health or safety conditions existing in, on, at, or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such conditions expressly are disclaimed. This sale will be made subject to all liens, assessments, or encumbrances, if any, and to all unpaid ad valorem taxes and special assessments, if any. The high bidder will also be responsible for the payment of recording fees and revenue stamps payable to the Register of Deeds and the final court/auditing fees payable to the Clerk of Superior Court which are assessed on the high bid resulting from this sale. A cash deposit (no personal checks) of five percent (5%) of the purchase price or Seven Hundred Fifty Dollars ($750.00), whichever is greater, will be required from the highest bidder at the time of sale as evidence of good faith. The balance of the purchase price shall be paid within twenty (20) days following expiration of the upset bid period upon delivery of a deed from the Commissioner.
