NOTICE OF SALE NORTH CAROLINA LENOIR COUNTY IN THE GENERAL COURT OF JUSTICE SUPERIOR COURT DIVISION BEFORE THE CLERK 18 SP 171 IN THE MATTER OF THE FORECLOSURE OF PROPERTY UNDER THOSE DEEDS OF TRUST EXECUTED BY AOF, LLC, DATED NOVEMBER 5, 2013 AND RECORDED IN BOOK1705 AT PAGE 429 AND BOOK 1705 AT PAGE 439 OF THE LENOIR COUNTY REGISTRY Under and by virtue of the power of sale contained in certain Deeds of Trust, executed by AOF, LLC dated November 5, 2013, and recorded in Book 1705 at Page 429 and in Book 1705 at Page 439, Lenoir County Registry, North Carolina, default having been made in the payment of the notes thereby secured by the said Deeds of Trust, and the undersigned, Richard F. Landis, II, having been duly substituted as Trustee in said Deeds of Trust, and the holder of said notes having directed that the Deeds of Trust be foreclosed, the undersigned Substitute Trustee will offer for sale at the Courthouse door, in the City of Kinston, Lenoir County, North Carolina at 11:00 a.m. on the 20th day of November 2018, and will sell to the highest bidder for cash the real estate, situated in Lenoir County, North Carolina, more particularly described as follows: Lying and being in the City of Kinston, Lenoir County, North Carolina, and being all of Lot 2, as shown on the plat dated September 25, 2000, entitled "Map for Record, Recombination of Lot 1 & 2, Kinston Cargo, L.L.C.", and appearing of record in Plat Cabinet 7, Page 145, of the Lenoir County Registry For informational purposes only, the PIN of the above-described property is 452613241766 and the address is 204 Airport Road, Kinston, NC 28504. LESS AND EXCEPT any portion thereof that has been released from the Deeds of Trust as of record prior to the date of this notice. Said property to be offered pursuant to this Notice of Sale is being offered for sale, transfer, and conveyance AS IS WHERE IS. There are no representations or warranties made regarding or relating to the title or any physical, environmental, health, or safety conditions existing in, on, at, or relating to the property being offered for sale. This sale is made subject to all taxes, special assessments and prior liens or encumbrances of record against the said property, and any recorded leases. The purchaser of said property is responsible for payment of recording fees and excise taxes on the instrument of conveyance and any land transfer tax assessed by Lenoir County. A cash deposit, certified check or cashier's check will be required at the time of the sale equal to five percent (5%) of the amount of the bid or $750.00, whichever is greater. An order of possession of the property may be issued pursuant to N.C.G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the Clerk of Superior Court of Lenoir County. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving this notice of sale, terminate the rental agreement upon 10 days' written notice to the landlord.
