NOTICE OF SALE NORTH CAROLINA CRAVEN COUNTY Under and by virtue of the provisions of N.C.G.S. 47F-3-116, and pursuant to the Claim of Lien filed by Cluster V Quarterdeck Owners Association, Inc. against SARA MEYERS in the Office of the Clerk of Superior Court of Craven County on March 27, 2018, in File 18-M-198, and by virtue of that certain Order entered October 16, 2018, by the Clerk of Superior Court of Craven County in File No. 18-SP-221, default having been made in the payment of the Claim of Lien being by the terms thereof subject to foreclosure, and the Association having demanded a foreclosure thereof for the purpose of satisfying said indebtedness, the undersigned will offer for sale at public auction to the highest bidder for cash at the Courthouse door in New Bern, North Carolina, at 11:00 a.m. on November 15, 2018, the property described in said Claim of Lien, the same being more particularly described as follows: Being all of Lot No. 164 as same is shown and delineated on a map or plat of Quarterdeck Townhouses, Cluster V, said map being recorded in Plat Cabinet B, Slide 349 in the Office of the Register of Deeds of Craven County, reference to said map being hereby made for a more perfect description of said property, bearing postal enumeration of 164 Quarterdeck, New Bern, NC 28562. The property hereinabove described will be sold SUBJECT to any and all superior liens, special assessments, encumbrances, or easements which appear of record, and SUBJECT to any and all ad valorem taxes due on said property. An order for possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the Clerk of Superior Court of Craven County. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement upon ten (10) days' written notice to the landlord. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination. The highest bidder will be required to make a deposit of ten percent (10%) of the bid price as evidence of good faith. This 16th day of October, 2018.
